Terms & Conditions of Business – Working Way Driving School

These Terms & Conditions of Business form the agreement between the student (including any person or organisation funding the tuition) and Working Way Driving School, including any instructor operating under the Working Way Driving School name.

By booking or attending lessons, the student confirms they have read, understood, and agree to these terms. Any amendments will be communicated at least 7 days prior to taking effect.

Code of Practice

  1. Working Way Driving School instructors follow the DVSA Voluntary Code of Practice for Approved Driving Instructors: gov.uk/adi-voluntary-code-of-practice.
  2. Tuition vehicles will be legally roadworthy, taxed, insured, and (where required) have a valid MOT.
  3. Vehicles will be clean, tidy, and fitted with dual controls.
  4. Instructors will act professionally and courteously at all times.
  5. Instructors will not make or receive calls or messages during lessons unless safely parked and only in an emergency.

Entitlement to Drive

  1. Students must hold a valid UK driving licence (provisional or full).
  2. Students must meet medical fitness standards, including reading a number plate at 20.5 metres (with corrective lenses if required).
  3. The licence must be shown at the first lesson and any changes (endorsements, penalties, bans) reported immediately.

Fitness to Drive

  1. Students must be fit to drive and disclose any illness, injury, or medication that may affect driving.
  2. Students must not attend lessons under the influence of alcohol, drugs, or drowsiness-inducing medication.
  3. Suitable clothing and footwear must be worn for safe control of the vehicle.

Behaviour

  1. Abuse or aggression towards instructors, examiners, or other road users will not be tolerated.
  2. Lessons may be terminated immediately if the instructor deems it unsafe to continue. Fees in such cases are non-refundable.

Lesson Fees

  1. Prices will be confirmed before or at the first lesson.
  2. Special offers are at the School’s discretion and may change without notice.
  3. Lessons must be paid in advance or at the start.
  4. Accepted payment methods: cash, bank transfer, or debit/credit card (where available).
  5. If payment is made directly to an instructor, the contract for those lessons is between the student and that instructor.
  6. No credit facilities are offered.

Change of Instructor

  1. Continuity with the same instructor will be maintained where possible.
  2. If a change is required, the student may accept or decline the replacement instructor.
  3. Requests for a different instructor will be accommodated as soon as possible.

  4. Change of Tuition Vehicle

    1. Vehicles may be changed temporarily or permanently for operational reasons.
    2. The School will not be liable for costs if the student declines lessons in a replacement vehicle.

    Cancellations by the Instructor

    1. Lessons may be cancelled at short notice due to weather, illness, or emergencies.
    2. Cancelled lessons will be rearranged at a mutually suitable time.

    Cancellations by the Student

    1. A minimum of 48 hours’ notice is required to cancel or reschedule a lesson, otherwise the full fee is payable.
    2. Cancellations must be confirmed directly with the instructor (call/text).
    3. Persistent cancellations may result in increased notice periods, prepayment for lessons, or termination of tuition.
    4. If, in the instructor’s opinion, the student is unfit to drive (alcohol, drugs, illness), the lesson will be cancelled and charged in full.

    Appointment Times

    1. Students are responsible for remembering appointment dates and times.
    2. Instructors will wait up to 10 minutes before marking a no-show as a chargeable late cancellation.
    3. Traffic delays may occur; additional time or a rate adjustment will be offered where appropriate.
    4. Alternative pickup/drop-off locations require 24 hours’ notice and may affect lesson duration.

    Driving Tests

    1. Tests should be booked only with the instructor’s agreement on readiness and availability.
    2. Students must confirm test date, time, and location with their instructor.
    3. Use of the instructor’s car for test is at the instructor’s discretion and charged at the normal hourly rate.
    4. The instructor may refuse use of their car for test if the student is not at test standard.

    Cancelled Driving Tests

    1. If the DVSA cancels a test, lesson and car-hire fees remain payable unless cancelled with the standard notice.
    2. Any reimbursement claims to DVSA are the student’s responsibility.
    3. Where possible, a replacement instructor/vehicle may be arranged for the booked test date, with the student’s agreement.

    Refunds

    1. Unused prepaid lessons are refundable subject to the cancellation policy.
    2. Where discounts were applied, lessons already taken will be recalculated at the standard rate before refunding any balance.

    Supervision

    1. Lessons may occasionally be observed for training or quality purposes with the student’s consent.
    2. Students may choose whether their instructor accompanies them on test (subject to DVSA procedures).

    Lessons in the Student’s Own Car

    1. At the instructor’s discretion, lessons may be taken in the student’s car subject to proof of insurance permitting professional instruction, and vehicle roadworthiness (tax, MOT).
    2. Use of the student’s car is entirely at the student’s risk.

    Student’s Property

    1. Working Way Driving School is not responsible for loss of, or damage to, personal belongings during lessons.

    Legal Liability

    1. Students are legally responsible for any motoring offences committed while driving.
    2. Instructors will teach to a high standard but cannot be held responsible for driving performance outside lessons.

    Complaints

    1. Please raise any concerns with the instructor or Working Way Driving School within 7 days of the issue.
    2. If unresolved, you may contact the DVSA for further guidance.

    Data Protection

    1. Personal data is stored securely and used only to provide driver training and related administration.
    2. Data will not be shared without consent unless required by law. You may opt out of non-essential communications at any time.

Our Hygiene Policy

  1. Students are expected to maintain an acceptable standard of personal hygiene during lessons. This includes wearing clean clothing and taking reasonable steps to ensure body odour does not cause discomfort to the instructor or others.
  2. If, in the instructor’s opinion, poor hygiene creates an unpleasant or unsafe learning environment, the lesson may be terminated. In such cases, the lesson fee will still be charged in full.
  3. Strong fragrances (perfume, aftershave, body spray) should be avoided as they can cause discomfort or allergic reactions.
